Below is the current list of approved arbitrators and organizations available to preside over a balance billing dispute.

How balance billing arbitration works

Parties to arbitration select an arbitrator or entity from the list. If the parties cannot agree, the OIC will narrow the list to five options. If the parties still cannot reach agreement, the OIC will choose the arbitrator from the narrowed list.

Once selected, the arbitrator presides over baseball style arbitration between health care providers, facilities and carriers. Arbitrators determine their own compensation rates under WAC 284-43B-037(7)(a) and the parties to arbitration split the cost regardless of who prevails, unless a party defaults. 

Rules applicable to arbitration can be found in RCW 48.49 and WAC 284-43B.

Arbitration and using the Balance Billing data set

Our office will announce in March 2025 whether it plans to transition the arbitration process to the federal dispute resolution process set by the federal No Surprises Act after July 1, 2025. The date of the transition is subject to change depending on feedback from the public and the outcome of pending legal challenges.

What is the BBPA?

The Balance Billing Protection Act (BBPA) protects consumers from getting billed by a nonparticipating (also known as “out-of-network”) hospital or provider for emergency services and for nonemergency services performed by a nonparticipating provider at a participating (also known as “in-network”) hospital, including both inpatient and outpatient services, or ambulatory surgical center.

If a consumer is treated by a nonparticipating provider or facility for services covered by the BBPA, the provider or facility will submit the claim to the consumer’s insurer. They will be paid a “commercially reasonable amount” which is based on payments for the same or similar services in a similar geographic area. The insurer and facility or provider must first try to agree on this amount.

How arbitration works

If the insurer and provider or facility cannot agree on the amount for the service within 30 days, the dispute is settled through arbitration. Either party can start the arbitration process by sending a notice to the OIC. That notice must also be sent to the party that is not initiating the arbitration. For example, if a provider is initiating arbitration, the notice must be sent to the insurer.

The parties then choose an arbitrator from a list of approved arbitrators or entities providing arbitration services. If they cannot agree on one, the list will be narrowed to five. If the parties still cannot agree, one will be assigned from the narrowed list.

The arbitrator will determine the final payment amount the insurer or provider must accept by choosing one of the parties' best final offer and then submit a decision reporting form and their decision to the OIC.  The arbitrator’s decision is final and binding on the insurer and provider.

BBPA arbitration forms and instructions

The BBPA rules include four forms that must be used for BBPA  arbitrations:

Memorandum and presentations for arbitrators regarding E2SHB 1688 (chapter 263, laws of 2022)

This memorandum addresses provisions of E2SHB 1688 that relate to arbitration proceedings under the BBPA. These changes apply to arbitration initiation requests submitted to the OIC on or after March 31, 2022.

Surprise billing data set

The BBPA requires the OIC to prepare a data set through a contract with Onpoint Health Data.  The data set was created in consultation with a workgroup that included representatives of medical providers, hospitals, ambulatory surgical centers and insurers. It serves as a source of objective information for insurers, providers and arbitrators. The data set includes the following information, by geographic area, for services covered by the BBPA:

  • The median in-network allowed amount;
  • The median out-of-network allowed amount; 
  • The median billed charge. 

The data set is based upon claims for services provided in calendar year 2018 and has been adjusted each year since 2019 by the Medical Consumer Price Index (CPI). 

A data set from the state’s All Payer Claims Database that includes services subject to the BBPA is available for insurers, providers and arbitrators as an independent source of claims payment information.

Self-funded group health plans and surprise billing

If an employer self-insures and wants to offer its employees more protections, it must opt-in to follow Washington state law.

New ground ambulance services protections and attestation

During the 2024 legislative session, Second Substitute Senate Bill (SSB) 5986 was enacted to add ground ambulance services balance billing protections to the Balance Billing Protection Act (BBPA) (RCW 48.49.200).  

In December, we contacted all SFGHPs that had opted in to follow the BBPA to notify them that if they wanted to include the new ground ambulance protections, they would need to update their attestation by Dec. 31, 2024. Any SFGHP that missed the deadline will have another chance to submit their attestation next year, but it must be submitted to our office 15 days before the plan year starts.

How to opt-in to the Balance Billing Protection Act

A self-funded group health plan must notify the Office of the Insurance Commissioner at least 15 days before it intends to participate in the Balance Billing Protection Act. If the plan is administered by a third-party administrator, that administrator must also follow the law.

Opt-in is for a full year unless the self-funded plan selects to automatically renew. The plan can participate for any calendar or plan year and must notify the OIC at least 15 days before the end of the year to opt-out.

How to apply to be an arbitrator

The Balance Billing Protection Act directs our office to develop a list of approved arbitrators or entities that provide arbitration for balance billing disputes. Arbitrators will preside over baseball style arbitration of these disputes between health care providers, facilities and carriers. Arbitrator compensation is determined by the selected arbitrator or organization. The OIC does not set rates or compensate arbitrators on the list. The parties to arbitration split the cost, regardless of which party prevails.

The Balance Billing Protection Act requires arbitrators to be trained by the American Health Lawyers Association (AHLA) or the American Arbitration Association. They also must have experience in matters related to medical or health care services.  

After your application to be an arbitrator is submitted, the OIC will let you know if you will be included in its list of arbitrators. If selected, the arbitrator or entity’s name and information submitted with the application will appear on the OIC webpage listing the approved arbitrators. Information provided on the application will be available to the public, as well as health care providers, facilities and carriers who initiate arbitration.
