How to file a demand for hearing

Who can file

Any person or entity who has been harmed by a decision, action or proposed action of the insurance commissioner can file a demand for hearing with the OIC Hearings Unit to challenge that decision, action or proposed action.

What's required

In your demand for hearing, briefly state how you are harmed by the commissioner's action or proposed action, and what relief you seek. Here is a sample letter demanding a hearing (PDF, 19KB) that you can use. If possible, attach a copy of the commissioner's order you are challenging. Include your contact information: name, mailing address, phone number and email address.

Filing deadline

If your demand for hearing isn't received by the OIC within 90 days of the date of the order or other act of the commissioner you are challenging, your right to demand a hearing is waived. If your demand for hearing is received before the effective date of the order, the requirements and penalties contained in the order will be postponed until a final decision is made by the presiding officer after your hearing. 

Submitting your demand for hearing

You can send the demand via postal mail, email, fax or hand delivery directly to the Administrative Hearings Unit, the deputy commissioner, or the OIC staff attorney who signed the order you are contesting.
