What to file...

Form You are required to file forms for all lines of insurance except foreign trade insurance, ocean marine, surety insurance (as defined in RCW 48.11.080), and surplus lines coverages. You must also file policy jackets, declarations pages, renewal certificates and any other form made a part of the policy. Do not file applications (unless made part of the policy), brochures, policyholder notices, manuscript forms used on a one-time basis, billing notices, binders, etc. [RCW 48.18.010, RCW 48.18.100(1) and WAC 284-20-100].
Rate/Rule You are required to file rates/rules for all lines of insurance except aircraft hull and liability, ocean marine, reinsurance, and surplus lines coverages. [RCW 48.19.010, RCW 48.19.040, RCW 48.29.140, and WAC 284-24-060]. For inland marine, you need not file rates and rules for classes to which, by general custom, manual rates or rating plans are not applied [WAC 284-24-080]. The notation "Refer to Company" in your manual, or rating organization's manual, does not dismiss the requirement to file rules and rates. [RCW 48.19.040 and WAC 284-24-070]

Effective July, 27, 2003, the Washington State Legislature made clarifications to the Personal Injury Protection (PIP) laws. Company claims staff should be informed of the statutory changes and a recent court case to ensure that losses are paid according to the law rather than in line with outdated insurance contract provisions.
