Insurance Fair Conduct Act

It's illegal for your insurance company to unreasonably deny your insurance claim or violate laws that govern unfair claims settlement practices.

If it does either, you have legal recourse as a policyholder to seek punitive damages in court.

If you want to sue your insurance company under the Insurance Fair Conduct Act, you must provide written notice of the potential lawsuit at least 20 days before filing the lawsuit to the:

  • Insurance company
  • Office of the Insurance Commissioner

Note: You must also allow three days for mailing the written notice.
